    • Guidance for applicants – in confidence

The position you have applied for is identified as exempt under the Exceptions Order of the Rehabilitation of Offenders Act 1974 (as amended in England and Wales).

This means that when considering any such appointment, the employing organisation is legally permitted to request a standard or enhanced disclosure through the Disclosure and Barring Service (known as a DBS check).

Standard and enhanced disclosures will include information about all SPENT (old) and UNSPENT (current) convictions, cautions, reprimands and final warnings that are not protected (i.e. are not filtered out) as defined by the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 (Amendment) (England and Wales) Order 2013.

Enhanced disclosures may also include other relevant police information where this is deemed relevant to the position you are applying for.

Before you complete this form, it is important to understand which convictions or cautions are now protected (or filtered) under an amendment to the Exceptions Order to the Rehabilitation of Offenders Act (as amended in England and Wales) which came into force from 29 May 2013.

Protected convictions and cautions will never be included in a standard or enhanced DBS disclosure. Applicants are not legally required to declare any such convictions or cautions to an employer, and the employing organisation is not entitled to consider any such offences as part of their recruitment process.

If you have a criminal record and have any queries or concerns about the type of information you may be asked to declare, please refer to the following sources for further guidance.

      Our commitment to you

Before you can be considered for appointment with your Trust we need to be satisfied about your character and suitability.

If the position has, in addition, been identified as a regulated activity under the Safeguarding Vulnerable Groups Act (2006) (as amended by the Protection of Freedom's Act 2012) an enhanced DBS disclosure will include information which is held on the Children's and/or Adults barred list(s), as applicable to the position.

Bank Partners aims to promote equality of opportunity and is committed to treating all applicants for positions fairly and on merit regardless of ethnicity, disability, age, gender or gender re-assignment, religion or belief, sexual orientation, pregnancy or maternity, marriage or civil partnership. We undertake not to discriminate unfairly against applicants on the basis of criminal conviction or other such information declared.

Prior to making a final decision concerning your application, we shall discuss with you any information declared by you that we believe may have a bearing on your suitability for the position.

If we do not raise this information with you, this is because we do not believe that it should be taken into account. In that event you still remain free, should you wish, to discuss the matter with the recruiting manager. As part of assessing your application, we will only take into account criminal records and other information declared which is relevant to the position being applied for.

The information that you provide in this declaration form will be processed in accordance with the Data Protection Act 1998. It will be used for the purpose of determining your application for this position. It will also be used for purposes of enquiries in relation to the prevention and detection of fraud.

Please answer all of the questions within this form.

If you answer ‘YES’ to any of the questions, please use the space indicated to provide any information that you believe may have a bearing on your suitability for the position for which you are applying.

It is important to stress that answering ‘yes’ to any of the questions below will not necessarily prevent you from taking up an appointment in the NHS. This will depend on the relevance of the information you provide in respect of the nature of the position for which you are applying, and the particular circumstances.

    • Equality Monitoring Information for all new starters

Why do we need accurate equality data?

The Trust needs credible, robust and up-to-date workforce data with integrity for monitoring and evaluation purposes. The result of the equality monitoring will inform the effective use of resources to improve competitiveness and make a valuable contribution to strategic planning processes and development of services. We currently have over 50% of our employee equality records showing not declared/undefined which makes it difficult to make informed decisions about the workforce.

What do we need from you?

The Trust needs you to update all your personal details so that we can hold accurate records on our ESR system, in particular those details relating to all protected characteristics as set out below:

      1. Age

      2. Disability

      3. Sex (Male or female)

      4. Gender re-assignment

      5. Race

      6. Religion or belief

      7. Sexual Orientation

      8. Pregnancy and Maternity

      9. Marriage or civil partnership (Marital Status)

How would we use this data?

The data collated will be used to up-date the ESR workforce data. All monitoring reports do not identify individual staff and confidentiality is maintained. The data will help enhance the integrity of the Trust’s workforce data.

      Data Protection Act 1998

The information you have provided will be stored and processed by North Middlesex University Hospital NHS Trust in line with the Data Protection Act 1998.

What is the benefit of a robust and complete workforce equality data?

For staff, the benefits in disclosing equality related information about themselves and the Trust include:

High quality recruitment analysis, equal pay review, access to training attendance, employee relations and salary information to ensure the Trust is paying due regard to the impact of its policies, functions and processes on its workforce. Where gaps are identified, it takes actions to address them equitably, fairly and promptly.
An accurate analysis of the Trust’s workforce to assist with planning of facilities, support structures, disability related adjustments, meet the diverse needs and requirements of its workforce.

    • If you are a substantive/fixed term member of staff you will automatically be set up with a Bank assignment in order to work any additional shifts in the same role as your substantive/fixed term post.  This may have implications regarding tax as HMRC consider this a second job and will tax you accordingly. You should seek confirmation from HMRC of your tax code for this assignment to ensure the correct tax code is applied.

PLEASE NOTE THIS DOES NOT APPLY TO FY1 DOCTORS WHO WILL REQUIRE MANAGEMENT SIGN OFF TO WORK ADDITIONAL SHIFTS IN THEIR OWN AREA OF WORK ONLY

    • Important information regarding the NHS Pension scheme.

You will automatically be entered into the NHS Pension Scheme upon commencement of employment. Should you wish to opt out, you must confirm that you are fully aware of the implications of opting out and have reviewed these using the online calculator available on the NHS Pensions website via the following link  https://www.nhsbsa.nhs.uk/member-hub.  The website will also provide you with information regarding future potential pension contributions. If you still wish to opt out you will need to complete and return the SD502 opt out form.

Please note under pension auto enrolment rules, anyone who opts out or stops making payments will be automatically enrolled back into a pension scheme at a later date (usually every three years). This is because your circumstances may have changed and it may be the right time for you to start saving. We will contact you when this happens, and you can opt out if it’s still not right for you.

Please note that you may not be eligible to join the NHS Pension Scheme and you may be automatically be enrolled in to NEST instead.  NEST is our alternative workplace pension scheme.  An example of someone that would not be eligible for enrolment into NHS Pensions is where they are already in receipt of their NHS Pension. Further information on auto enrolment can be found via the following link  http://www.nestpensions.org.uk/

    • New Employee Questionnaire
    • As part of the recruitment process, all new employees, staff transferring in from another NHS employer and existing NHS employees must complete this questionnaire as fully as possible.

The NHS Pension Scheme legislation requires employers to contractually enrol all new eligible employees into the NHS Pension Scheme on commencement of their employment. The Pensions Act 2008 requires those employees who cannot join the NHS Pension Scheme to be automatically enrolled into an alternative pension scheme. In order to ensure that you are correctly enrolled your employer needs to establish your current NHS pension status.

Please note that the information provided will only be used for local and central pensions/payroll administration purposes to determine your eligibility criteria to join the NHS Pension Scheme.

Please use the completion notes whilst completing the form.

    • Which NHS Pension Scheme did you take your benefits from?*
    • If you have never held MHO status your new post will not qualify for this status. (Go to Q10)

    • If your answer is ‘Yes’, you should download the Transfer In Guide and application pack from our website at: www.nhsbsa.nhs.uk/pensions. However, it is important to note that this can only be done in the first 12 months of joining the Scheme for members of the 1995 Section, or within the first 12 months of becoming eligible to join the 2008 Section or 2015 Scheme. (Go to Part 2)

If you would like to consider your option to transfer benefits, please tick the ‘Yes’ box and download the Transfer In Guide and application pack. If you say no but decide at a later date that you wish to consider a transfer (within the 12 month deadline) then you can obtain the Transfer In Guide and application pack from your employer or the NHS Pensions website (www.nhsbsa.nhs.uk/pensions). If you have previous NHS pension membership within England and Wales this will be automatically added to any new membership in the NHS Pension Scheme. If you have previous membership of the NHS Pension Scheme in Scotland or Northern Ireland, this will not be automatically linked.  You must apply to transfer these benefits if you would like your membership to be added to your new membership in the NHS Pension Scheme (England and Wales).

If you wish to transfer from a scheme that participates in the Public Sector Transfer Club, please note that you must 'elect to proceed' with this transfer within 12 months of becoming eligible to join the NHS Pension Scheme (an election to proceed is not a request for an estimate, it is the signed option form requesting payment of the transfer value).

Once the assessment has been made, you will be notified by your employer by the first pay day which Scheme you have been enrolled in, what the Scheme features are, the contribution rates and your options.

Assessment is not possible until your first payment is made.

For more information about who we share your information with and how long we keep your personal data and your rights, please visit www.nhsbsa.nhs.uk/yourinformation.

    • Completion notes

These completion notes are provided to assist you in completing the new joiner questionnaire.

Please complete the questionnaire as fully as possible so that the correct assessment can be
      made.

Q1 – This question is to establish if you have any previous NHS Pension Scheme membership at
the date of starting this new employment.

Q2 – This is to establish whether you will have any other NHS employments at the same time as
      your new role.

Q3 – This is to ensure you do not have an overlapping employment.

Q4 – You can only be pensionable in this Scheme up to whole time, therefore it is important that
your employer knows how many hours you work in your other employment(s). Please make sure
that you keep your employer/payroll informed if the situation changes.

Q5 – If you are continuing to work in another NHS post we need to know who your other NHS
employment is with. This is important as there are reasons why you may not be eligible for the
NHS Pension Scheme in two employments. The name of your other employer may be the same as
the one you are starting with. Please note that if you are working for an NHS organisation through
an employment agency, this does not count as NHS employment.

Q6 – If you are in receipt of any NHS pension benefits then you may not be eligible to rejoin the
NHS Pension Scheme. However, by providing the information requested we will be able to make
the correct assessment. We ask you to identify which Section or Scheme you were in (1995
Section, 2008 Section or 2015 Scheme) but if you are unsure then please tick the ‘Not known’.

Q7 – NHS service that has been counted in the calculation of a redundancy payment needs to be
declared to ensure the correct assessment of your service. If you are in receipt of an NHS Pension
as the result of redundancy, this will impact the assessment.

Q8 – If you have Additional Voluntary Contribution (AVC) arrangements with either Equitable life,
Prudential or Standard Life through the NHS Pension Scheme then you need to inform the AVC
provider that you are changing employer to ensure continuity can be considered.

Q9 – If you have either Added Years, Additional Pension purchase or Early Retirement Reduction
Buy Out (ERRBO) through the NHS Pension Scheme it is essential that you confirm the details
and provide a copy of the contract that was provided to you when you commenced the
arrangement to ensure continuity of the arrangement.

Q10 – Please note that Mental Health Officer (MHO) status no longer applies to any post
commenced after 6 March 1995. However, if you have previously held a post that attracted MHO
status and you believe the new post also qualifies for MHO status then you need to indicate this by
ticking ‘Yes’ and completing the details of the previous employment.

Q11– Please note that Special Class status (SCS) no longer applies to any post commenced after
6 March 1995. However, if you have previously held a post that attracted SCS status and you
believe the new post also qualifies for SCS status then you need to indicate this by ticking ‘Yes’
and completing the details of the previous employment.

Q12 – Refunded membership may be included in your qualifying membership (membership
counting towards your maximum allowed membership) but will not be included in the calculation of
your pension benefits. Also, should you have taken your refund within the last 6 months you are
entitled to pay it back should you wish to increase your current membership of the Scheme.

Q13 – You may be able to transfer other pensions into the NHS Pension Scheme, however it is
important to note that this can only be done:

      • in the first 12 months of joining the Scheme if you are member of the 1995 Section
      • within the first 12 months of becoming eligible to join the 2008 Section
      • within the first 12 months of becoming eligible to join the 2015 Scheme.

If you would like to consider your option to transfer benefits, please tick the ‘Yes’ box and
download the Transfer In Guide and application pack. If you say no but decide at a later date that
you wish to consider a transfer (within the 12 month deadline) then you can obtain the Transfer In
Guide and application pack from your employer or the NHS Pensions website
(www.nhsbsa.nhs.uk/nhs-pensions). If you have previous NHS pension member ship within
England and Wales this will be automatically added to any new membership in the NHS Pension
Scheme. If you have previous membership of the NHS Pension Scheme in Scotland or Northern
Ireland, this will not be automatically linked. You must apply to transfer these benefits if you would
like your membership to be added to your new membership in the NHS Pension Scheme (England
      and Wales).

      If you wish
to transfer from a scheme that participates in the Public Sector Transfer Club, please
note that you must 'elect to proceed' with this transfer within 12 months of becoming eligible to join
the NHS Pension Scheme (an election to proceed is not a request for an estimate, it is the signed
option form requesting payment of the transfer value).

Once the assessment has been made, you will be notified by your employer by the first pay day
which Scheme you have been enrolled in, what the Scheme features are, the contribution rates
      and your options.

Assessment is not possible until your first payment is made.

      Death Benefit Nomination Forms
In the event of your death, the NHS Pension Scheme may provide for your family or a person you
      have nominated.
You can nominate someone to receive a lump sum on death benefit if you die using the lump sum
      on death benefit nomination forms.
If you have a partner, but are not married or in a civil partnership, you may also be able to
nominate them to receive an adult dependant’s pension using a separate form.
You can also cancel or change a previous nomination.
For further information please visit our website at www.nhsbsa.nhs.uk/member-hub/nominations
where you will also find the relevant forms.

    • UCLH Pension
    • IMPORTANT INFORMATION FOR APPLICANTS JOINING THE UCLH BANK – ALLIED HEALTH & SCIENTIFIC STAFF AND NON-CLINICAL STAFF

Please read the information below which details how any assignment you may undertake at UCLH is affected by:

      The European Working Time Regulations
      The Agency Worker Regulations
      Pension auto enrolment
Individuals working through a Limited Company are not affected and should not sign this document.

The European Working Time Regulations were introduced in 1998 to regulate working times including break periods and not working for more than an average of 48 hours over a 17 week period unless agreed otherwise.

With regard to an assignment at UCLH, you need to be aware that holiday pay (a Regulation requirement) is paid on top of your standard hourly rate so you receive an element of holiday pay for every hour you are paid for. It is not accrued separately for you. You do however need to ensure that you are taking the European Working Time Regulations recommended annual leave. When an assignment is confirmed for you at UCLH you will receive a welcome pack which will include an assignment confirmation that contains instructions for your first day, the length of the assignment and the breakdown of your pay to clearly show your standard pay and holiday pay amounts.

The Agency Worker Regulations also apply for any assignment that you undertake through the bank at UCLH  even though you will be working through the bank, not an agency. The regulations apply because your assignment is not classed as permanent employment. Under the Agency Worker Regulations, you are eligible for a series of entitlements from day one. These are listed below, and a copy of this table will be included in your welcome pack.

Facilities – such as the staff canteen, 52 club, transport facilities, car parking and child care facilities.
Vacancies – bank and agency workers will have the right to be notified of any job vacancies within the organisation including those that are advertised for internal applicants only.
For further information about any of the facilities above, please speak to your bank consultant. Job vacancies are all advertised on the Trust’s website job pages.

In addition to the day one entitlements, you are also eligible, after your twelfth paid week in your assignment, to be paid at an equivalent rate to that of a permanent employee AND have the equivalent holiday entitlement of a permanent employee - if you are not already receiving the equivalents on either or both counts. Your assignment confirmation in your welcome pack will clearly detail what rates you are receiving for your standard and your holiday pay, and what, if any changes you will automatically receive from your 12th week of payment. A change in rate, if applicable, will carry over from one assignment to the next as long as the assignments are at the same band.

Pension auto enrolment has been implemented in companies across the UK in accordance with the government's directive throughout 2013 and will apply to you in your bank assignment if you are eligible to be auto enrolled. Every individual will be assessed for their eligibility on a case by case basis, and for those that are eligible, a 1% deduction from your salary will be applied, and a further 1% contribution will be made by us. For further information about pension auto enrolment, including how eligibility is assessed, please visit the government website.

Please sign below to confirm that the above regulations have been discussed with you as part of your application to join the UCLH bank.
